Construction Business, Contract and Public Procurement Legislation
Module Description
Business Law: The module examines the general principles of Maltese Law which have a major impact in the business environment in which Construction Mangers operate.
Contract Law: The module is an introduction to the general principles of contract law as it relates to construction industry. It examines the nature and constitution of contracts as well as the relationship between the parties. The legal requirements relating to disputes and arbitration are considered.
Public Procurement Law: The different aspects underpinning public procurement particularly those relating to construction works contracts are introduced, together with the processes of tendering and tender adjudication and the related frameworks.
Entry Requirements
Candidates who apply for this course must possess one of the following:
- a Level 6 degree in a related field;
OR
- a Level 5 diploma or higher diploma and 5 years’ work experience in a managerial role.
Preference is given to applicants having a Level 6 degree in a discipline related to construction, and a minimum of 3 years’ work experience in management within the industry.
Target Audience
This course is targeted at professionals with supervisory and/or middle management experience in the construction industry who wish to have a more thorough background in the subject in order to further advance their careers , namely:
- Architects and Civil Engineers
- Mechanical and Electrical Building Services Engineers
- Project Managers and Coordinators
- Project Owners
The target group can be extended to groups working within the construction industry, such as logistics managers, maintenance managers and facilities managers.
Career Paths
This programme aims to prepare you for senior posts within the industry, such as that of construction manager, head of the construction department or construction director of any construction organisation both in the private and public sector.
How you’ll be assessed
The course comprises:
- Evening classes for part-time courses.
- Classes held throughout the day for full-time courses.
- Guided learning, presentations, comprising synchronous online discussions, tutorials and/or videos.
- Self-study hours comprising research, reading and assignment work.
Assessment
Assessment is carried out via two mandatory components:
- Assessment 1
- Assessment 2
The programme includes different forms of assessment which allow for and promote students’ critical engagement. The formative and summative assessment tasks may include an in-class assignment and/or a home-based written assignment using diverse assessment tools which may take the form of online and in-class discussions, examinations, case studies, reports, proposals, essays, and presentations, etc., as applicable to the diverse modules.

Business Law
- Critically analyse the core business law rules in context of construction organisation.
- Critically examine the development of the law over time and to identify the major influences for construction industry.
- Critically analyse the derivation of business law from primary sources and develop techniques of legal research in construction settings.
- Develop analytical approaches to legal problem solving in construction settings.
Contract Law
- Critically analyse the sources and principal provisions of contract law in the management of the construction contracts.
- Critically appraise through research and problem solving the solutions in dealing with the technicalities of the substantive contract law as it applies to construction industry.
- Assimilate and evaluate complex legal materials from a range of legal sources relevant to construction projects.
Knowledge:
Students successfully completing this module will be able to:
Business Law
- The essential principles relating to the formation, content, defects, discharge and remedies for breach of construction business contracts.
- The essential principles relating to tort, with special reference to negligence, defamation, nuisance, and trespass as relevant to the construction industry.
- The law relating to employment relationships with particular regard to dismissal, redundancy, discrimination and health and safety issues relevant to the construction industry.
Contract Law
- Contract law appropriate to the construction industry.
Public Procurement Law
- Public procurement law and regulations, particularly those to tendering, tender evaluation as well as the rights and obligations of bidders of construction related tenders.
Skills:
At the end of the module/unit the learner will have acquired the following skills:
- Critically evaluate the competing legal theories relevant to the general principles of business and corporate law by applying rules of precedent and statutory interpretation.
- Critically analyse the political, moral and economic pressures that determine the form, content and development of aspects of the general principles of business, contract and public procurement law.

The learner will be able to:
- Assimilate and evaluate complex legal materials from a range of legal sources.
