Module Description

This module introduces the fundamental concepts concerning legal regulation in the tourism and hospitality industry. The module will explore the legal and regulatory frameworks that govern the tourism and hospitality industry, including issues related to taxation, employment law, and health and safety regulations.

Students will get the opportunity to review various local and EU statutes, policies, regulations, and law cases and apply them accordingly to the operations of the tourism and hospitality industry.  

Entry Requirements

Candidates who apply for this course must possess:

  • A qualification at MQF Level 4 (one ‘A’ Level or equivalent in any subject) and a pass in English Language* and Mathematics at MQF Level 3 (‘O’ Level or equivalent).

In the case of students who do not possess all the formal required academic qualifications, then the Recognition of Prior Learning (RPL) process could be applied such that if evidence of equivalent learning is found then the applicant could still be accepted on the course. Such RPL process will subject applicants to an interview held with a board of experts within the field, chosen specifically by IDEA College, so as to verify their experiences and prior learning.

Evidence may include:

  • A detailed CV outlining relevant work experience and responsibilities.
  • Employer reference letters outlining job role, duration, and key competencies.
  • Related documentation demonstrating relevant skills (e.g. work portfolio).

*Students whose first language is not English and do not possess an ‘O’ level pass in English Language will be required to demonstrate English language capability at IELTS level 6.0 or equivalent.

How you’ll be assessed

The course comprises:

  • Evening classes for part-time courses.
  • Classes held throughout the day for full-time courses.
  • Guided learning, presentations, comprising synchronous online discussions, tutorials and/or videos.
  • Self-study hours comprising research, reading and assignment work.

Assessment

Assessment is carried out via two mandatory components:

  • Formative Assessment
  • Summative Assessment

The programme includes different forms of assessment which allow for and promote students’ critical engagement. The formative and summative assessment tasks may include an in-class assignment and/or a home-based written assignment using diverse assessment tools which may take the form of online and in-class discussions, examinations, case studies, reports, proposals, essays, and presentations, etc., as applicable to the diverse modules.

Competences:

At the end of the module/unit, the learner will have acquired the responsibility and autonomy to: 

  • Develop and demonstrate knowledge in relation to the underpinnings of law, judicial concepts, and legal reasoning.  
  • Evaluate the Malta Travel and Tourism Services Act. 
  • Be able to differentiate the main tourism and hospitality-related taxes, fees, and charges applicable in EU countries. 
  • Critically discuss and review EU legislation in the tourism and hospitality sector. 
  • Become familiar with and examine the Employment and Industrial Relations Act. 
  • Apply the Occupational Health & Safety (OHS) Legislation to different legal scenarios within the tourism and hospitality industry.  
  • Conduct a Health and Safety Risk Assessment.  
  • Distinguish between internal and external reporting. 
  • Appraise the process of taking legal action in the tourism and hospitality industry.  
  • Critically assess the changing nature of local and international trends and align the future vision with the enhancement of the tourist experience. 
  • Critically apply legal and policy frameworks in a strategic and innovative manner to support sustainable, ethical, and competitive practices within the tourism and hospitality industry.

Skills

At the end of the module/unit, the learner will have acquired the following skills:

  • Apply tourism and hospitality law and policies to any circumstance which fall under this area of the law. 
  • Critically assess court cases objectively pertaining to the tourism sector.  
  • Integrate tourism and hospitality policies and set achievable goals to improve the respective sectors.  
  • Draw up a health and safety risk assessment report. 
  • Design and justify strategic and innovative policy recommendations or compliance frameworks that address current and emerging legal challenges in tourism and hospitality.

At the end of the module/unit, the learner will be able to: 

  • Understand legal termination in business contracts. 
  • Evaluate business contracts relevant to the tourism and hospitality industry. 
  • Tackle licensing procedures accordingly.  
  • Identify and deal effectively with issues related to liability and rights. 
  • Identify and/or formulate alternative dispute resolution options.
