Module Description

This module will help the students understand the contracts law when dealing with different property and compare it with foreign ones when dealing with international stakeholders.

Notaries play a key role throughout the process; for this reason, students will explore this field and the required documentation involved.

This module will help students understand recent updates and changes in relevant acts i.e. contracts and anti-money laundering.

Entry Requirements

Candidates who apply for this course must possess:

  • School leaving certificate, passed examinations in English Language, Maltese (or mother language if it’s a foreigner); and
  • Minimum age: 16+

OR

1 year of experience in relevant field

Target Audience

This course is targeted at:  

  • Property Consultants
  • Sellers
  • Negotiators
  • Administration
  • Workers working in the real estate industry. The target group can be extended to groups such as: construction companies, contractors and developers.

Career Paths

This course prepares students for the relevant license to operate in the capacity of real estate agents, property brokers and property consultants, as per the ‘Real Estate Agents, Property Brokers and Property Consultants Act’, enacted in 2020.

Furthermore, this programme aims to increase the employability of individuals interested in working in the real estate and construction industry. 

 

How you’ll be assessed

The mode of assessment varies and may include in-class tasks and home-based written assignments using diverse assessment tools which may include care studies, reports, proposals, essays, presentations, multiple-choice questions assessment, as applicable to the diverse modules.

Assessment

  • Formative assessment will take place during the session in the form of discussions, feedback, etc., but it will not be graded and, therefore, will have no weighting.

Learning Outcomes

Competences:

  • Understand the contracts law for different types of property.
  • Be aware that Maltese local law may not always correspond to foreign legislation.
  • Adapt different types of contracts and promises of sale.
  • Understand the notary’s role in the local scenario.
  • Reflect on trending difficulties when applying anti-money laundering legislation.
  • Comprehend the process of building construction and become aware of any related legislations.
  • Familiarise oneself with different types of legislations (GDPR legislation, AML legislation, planning/BCA related legislation, etc.).

Knowledge:

  • Familiarise oneself with the contents of Chapter 615.
  • Understand contracts law and its application.
  • Demonstrate an understanding of planning/BCA related legislation.
  • Describe the different types of contracts and promises of sale.
  • Identify the process of sale.
  • Describe the process to draft contracts effectively.
  • Understand the role of mediators and arbitrators.
  • Describe the role of Malta Arbitration Centre and international arbitration centers.
  • Appraise the Land Registration Act and its application.
  • Understand civil law and how it regulates the property matters.
  • Demonstrate an understanding of civil law concepts related to the property market.
  • Understand court procedures and verification of titles.
  • Comprehend anti-money laundering (AML) legislation.
  • Familiarise oneself with GDPR legislation.

Skills:

  • Identify the changes and/or updates in any related legislation and comply with the resulting obligations.
  • Outline and examine the differences of applicable regulations.
  • Comply with any new set of laws.
  • Demonstrate an understanding and knowledge of notarial work and duties.
  • Demonstrate knowledge of different types of legislations such as planning/BCA related legislation, GDPR legislation, and anti-money laundering legislation.
